Please note, all driving instructors are self-employed and operate under a franchise with GoodeDriver
If you have chosen to undertake on-road driving tuition in a motor vehicle, this agreement is between you, and your Franchised Instructor (an 'Instructor'). No contractual liability shall arise or subsist between you and Goodedriver. (Please note that all major driving schools in the UK (e.g. BSM and the AA) operate in this way with self-employed franchised instructors).
Your Instructor
i) All GoodeDriver instructors are bound by a professional code of conduct. Your instructor will be courteous, polite, tidy and punctual. He or she will also behave in a professional and ethical manner at all times.
ii) GoodeDriver instructors will not smoke in the car while giving tuition, nor will they use your lesson time for any other form of business, personal or otherwise.
The Vehicle
i) Your GoodeDriver instructor's car will be well maintained, clean and tidy. All cars used by GoodeDriver instructors are fitted with dual-controls as part of their standard equipment.
ii) If you are taking on-road lessons, your Instructor will carry the appropriate motor insurance should you cause an accident as a learner whilst driving the Instructor's tuition vehicle, whether you are accompanied by an Instructor or a Driving Standards Agency Examiner.
Requirements
i) To take on-road lessons, it is your responsibility to ensure that you have the required licence to drive under the tuition of an Instructor. In the UK, to take driving lessons in a motor vehicle, you must be at least 17 years old (unless you are disabled, in which case you must be at least 16 years old) and hold a valid provisional driving licence. You will be asked by your Instructor to show your provisional driving licence at your first lesson.
ii) You must also check that they can read a number plate at a distance of 20.5 metres (i.e. 67 feet - about 5 car lengths) with glasses if normally worn.
iii) In the interests of comfort and safety you are advised to wear suitable footwear and clothing which does not restrict movement. Please also advise your Instructor of any medication which you are taking, which may impair your ability to drive safely.
Lessons
i) Duration - Most on-road lessons are scheduled to last 2 hours, although in certain circumstances (e.g. before your driving test) one-hour lessons may be available.
ii) Payment - You must pay for each lesson in advance. Payment for the current or next lesson will normally be made direct to your Instructor. The Instructor shall provide you with driving tuition at the rate per hour communicated to you from time to time. Current prices are available upon request.
iii) Lesson Postponement and cancellation - You must give the Instructor at least two working days' notice (a working day being Monday to Friday inclusive) if you wish to cancel a driving lesson, otherwise you will still be liable for the lesson fee in respect of that lesson.
iv) Instructor Cancellation - If you are taking on-road lessons, and your normal Instructor is unavailable for any reason, the Instructor has the right to arrange for another Instructor to provide some, or all of your on-road driving tuition. If your Instructor cannot arrange for an alternative Instructor to take your driving lesson, or in the event of mechanical breakdown of the vehicle in which you have been learning to drive, or for any other reason, the Instructor reserves the right to rearrange a driving lesson to a time convenient to both you and the Instructor.
v) Punctuality - In your own interests, you are advised to be punctual for their lesson appointments. All such appointments should be recorded to ensure that mistakes are avoided. The GoodeDriver instructor would normally wait for a maximum of 15 minutes before the lesson would be abandoned and the lesson fee forfeited or become due for payment.
vi) Instructor Delay - If your Instruction is delayed due to unforeseen circumstances, they will attempt to contact you, if it is safe to do so. A waiting time may become necessary. Any lesson time lost as a result of this would be made up by the GoodeDriver instructor either at the end of the normal lesson time if possible or at a later date. Any such shortfall should be agreed and recorded. Alternatively, it is not feasible to delay the start of the lesson, it may be rearranged to a time convenient to both you and your Instructor.
The Driving Test
i) Bookings Driving tests can be booked by you or your GoodeDriver instructor. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else's driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. Test appointments must be notified to your GoodeDriver instructor as soon as they are known; otherwise he or she cannot guarantee to provide a vehicle for the test.
ii) Use of the vehicle In the interests of customer and public safety your GoodeDriver instructor reserves the right to withhold the use of a car for the test if, in their opinion, your driving is actually or potentially dangerous.
iii) Test cancellation Three clear working days notice of cancellation or postponement is required by the DSA. Failure to provide the required notice will result in the loss of your test fee. Your GoodeDriver instructor cannot be held responsible for any postponement or cancellation of tests by the DSA.
Miscellaneous
i) Consumer Protection Whilst every effort is made to ensure that the Website does not contain any error, defect, malfunction or corruption, GoodeDriver does not accept responsibility for any damage to or loss of data on your computer system, network or server that results from the download or use of the Website. Nor does GoodeDriver accept responsibility for loss of data including both data transmitted and other data held by you, or delay, or failure, in transmitting or receiving data, or indirect, or consequential losses arising from use of GoodeDriver Website, including loss of revenue, business, anticipated savings on profits. GoodeDriver does not make any representation or warranty that the Website will meet your expectations or requirements, or that any particular results will be obtained from their use.
ii) Third Party Links - GoodeDriver may choose from time to time to have various third-party websites linked from the Website. This will include links to sites owned by GoodeDriver and associated companies. These third-party links are provided for your convenience only and are accessed at your own risk. You agree GoodeDriver has no responsibility or liability for any independent policies or actions of these third-party sites and is not responsible in any way for the privacy practices, customer service practices, content or availability of any such websites. You also agree that GoodeDriver shall not be responsible in any way for any damage or loss caused in relation to the content, goods or services available through such websites.
iii) Website Availability - GoodeDriver uses its best endeavours to ensure that the Website is available 24 hours a day 7 days a week. There will be occasions when the Website will be interrupted for maintenance, upgrades and emergency repairs and you agree that GoodeDriver shall not be liable to you, or any third party, for any modification, suspension or discontinuance of the Website. Every step will be taken by GoodeDriver to minimise disruption. However, GoodeDriver cannot be held responsible for any disruptions that are inherent in the operation of the Internet and World Wide Web including viruses.
Other provisions
i) Goodedriver will not be liable for any unforeseeable losses, losses that were not caused by our negligence or for any business losses. This does not apply to any claim you may have for death or personal injury. Nothing in this term will affect the statutory rights you have regarding faulty or misdescribed products and services or any failure by us in providing our services.
ii) We do not guarantee to provide, or procure the provision of, services if we are prevented from doing so in circumstances beyond our reasonable control, including without limitations, the activities of civil or government authorities, third party industrial disputes, internal industrial disputes where we have taken reasonable steps to prevent the effects of such action on our services but have been unable to do so; acts of God; or severe weather conditions.
iii) We reserve the rights to make reasonable changes to the products, and these terms and conditions, for commercial, system, security, legal or regulatory reasons and we will give you reasonable notice of such changes. If such changes mean that the services we provide to you are substantially varied to your detriment you may cancel your agreement with us.
These terms and conditions are governed by the laws of England and Wales.
